Brazilian Touch(hereinafter referred to as "The Website") is a Website and domain name created, owned and operated by Brazilian Touch("The Company"). Brazilian Touch and its logos are trademarks of The Company. All other images and product names used on The Website are property of their respective owners. The Website and all content and information contained on the pages herein are protected by copyright and intellectual property laws. All information included on this site, including, but not limited to, any and all text, graphics, logos, images, articles and such, is the sole property of The Company. No material or information contained on this Web Site shall be downloaded, used, copied, reproduced, republished, posted, transmitted, transferred, distributed, or exploited in any way without the previous written consent of The Company. Any unauthorized downloading, use, copying, reproduction, republication, posting, transmission, transfer, distribution or exploitation of such materials and information is prohibited. CONDITION OF SALE:
All sales are final and all products sold by Brazilian Touch are sold "as is" to the Buyer and are subject to a 25% restocking/cancellation fee. Orders may be subject to extra security checks which may include confirmation of Credit/Debit card details and full address details. Brazilian Touch reserves the right to cancel any orders if this information cannot be supplied.

DAMAGES:
Products that are damaged through the negligence of the shipping company (Freight Line/UPS/ETC.) customers must report the damages to that shipping company within 24 hours after receiving order. If not customer could be held liable for all damages acquired through shipping. Please remember do not discard any portion of the packaging material. The shipper will send a representative to inspect the carton and its contents. Always remember to personally inspect all packages prior to signing acceptance of shipment. Failure to do so can hold you liable for damages.

RETURNS:
Authorization to return any and all products must be obtained by the buyer from Brazilian Touch in advance and must be made within seven (7) days of receiving the product. All returned products to Brazilian Touch are subject to 25% restocking fee. Buyer must pay for all Shipping/Handling fees on any and all returns to Brazilian Touch. All products, which are approved for return, are for merchandise credit or full refund minus shipping costs. All products returned for credit must be in the original shipping carton in the same condition as it was originally delivered by Brazilian Touch to the buyer. We will not accept a return on any merchandise that has been drilled, primed, used, broken, etc. Only the original buyer may request for a return of products. Defective items may be exchanged for the same item only. After receipt of goods, Brazilian Touchshall inspect the goods to determine the exact condition of goods received. If Brazilian Touch does not accept the goods as being defective and/or returnable for any reason, buyer must accept incurred costs. Special Order Items are not returnable.

BACKORDERS:
To avoid backorders, we try our best to maintain a good stocking level. However, if we run out of an item, your order will be placed on backorder, and we will ship your order as soon as possible. Back order(s) must be cancelled within five (5) working days or items will be automatically shipped to you. We always attempt to ship orders the next business day. If the item is NOT on BACKORDER, allow 7-10 business day for shipping. Special order(s) take 10-15 business days. Buyer is responsible for all shipping charges returns/shipping. Varying on product production, back orders may take anywhere from 4 to 12 weeks. If you would like to cancel your back order, there is a 25% cancellation/re-stocking fee.

SHIPPING:
We at Brazilian Touch will make every effort to ship your products within 48hours of receiving your order if your order is in stock. Our order and handling charge includes normal parcel post shipping. Surcharges may apply for large or oversized items and/or if you live in an area (certain northern or remote locations) serviced by an air stage point. USPS is the preferred method of shipment unless the merchandise is too large for USPS standards, which would require shipping by common carriers (truck freight). Brazilian Touch reserves the right to change carrier without further notice to the customer.

1 – Shipping Rates: Shipping rate on orders will vary. Customer may be charged for the difference between Carrier final amount and Brazilian Touch shipping and handling amount once order is shipped out.

2 – Standard Delivery: Most purchases are shipped from our warehouse in California (USA) and should arrive within 7 to 14 business days of your order. In the event of a delay, we will notify you by e-mail within 48 hours. On orders that involve multiple items, we may be out of stock on certain items on your order. In this case we will advise you and request your direction (ship complete or in stages). Unless directed specifically, we will wait until your order is complete as this will be the most economical for you.

4 – Customs Clearance Policy: Please be aware that customers from foreign countries will bear the sole responsibility for any taxes and duties your local customs office may charge. We are required by law to disclose the full value of the package contents and cannot alter this value. If you refuse any shipment from Brazilian Touch, you are still responsible for the original shipping costs as well as any duties, taxes and customs charges. This amount will be subtracted from your merchandise refund. Please note: We cannot be held responsible for customs actions (damage or duties, fees, etc) upon opening your package, as well as any associated costs of returning the package to Brazilian Touch.

5 – Rush Delivery (Next Day, 2-3 business days): Only for items that we have in stock, your expedited order should be received within 2-3 business days. Please be aware that we will always search for the most economical way to ship your package.

6 – Delivery Special Items: Because a surfboard is considered a large, our couriers may charge a higher rate for these items as the cost to ship is higher then smaller items. Therefore, these items may have a flat rate shipping charge.

7 – Shipping to a P.O. Box: Items can not be shipped to a P.O. Box.

8 – Tracking Your Package: Once your shipment has been confirmed, a tracking number will be sent to your email address, or you can visit your online account and the track your order page which will also provide you with a tracking number.

9 – Scheduled Deliveries: We at Brazilian Touch will make every effort to maintain a scheduled arrival time for your package(s), we will contact you by e-mail or by phone should any problems arise with the scheduled shipping time and delivery. If we are not able to fulfill your service selection you will be given the option to cancel your order or accept the new shipping terms.

PAYMENT:
All shipment(s) must be prepaid no COD. Payments are accepted in master, visa, AMEX and discover only. All shipments drop ship/picked up (own courier) to another address will be subject to a $20.00 handling fee.
